Hamilton and Burr had an acrimonious relationship that dated to 1791, when Burr defeated Hamilton’s father-in-law, Gen. Philip John Schuyler, for a seat in the U.S. Senate. According to historian Thomas Fleming, Burr would have immediately published such an apology, and Hamilton's remaining power in the New York Federalist party would have been diminished.  One newspaper wrote that Burr had conducted the proceedings with the "impartiality of an angel, but with the rigor of a devil". (At that time, circuit courts had original jurisdiction to try treason cases; the Supreme Court has never had that power.) By the spring of 1776, Burr had achieved the rank of major, and was appointed to serve under George Washington at his home in New York. Burr served in the New York State Assembly from 1784 to 1785.
